Terms of Service

2.1 The Service is a golf scorekeeping and game-management application — it is not a gambling application, betting platform, or wagering service of any kind. Fore Skins lets you record golf scores, organize playing groups, and run supported game formats — including Stroke Play, Best Ball, Scramble, Alternating Shot, Head to Head, Nassau, Bingo Bango Bongo, Wolf, and Skins — as well as track prop-style side games such as Longest Drive. All game outcomes are expressed in points only. No monetary values, dollar amounts, or financial calculations of any kind are used, stored, or displayed anywhere within the Service. The Service records golf scores and points earned in game formats. It does not record, track, or facilitate bets, wagers, or gambling of any kind.

2.2 We do not operate any gambling business, and we are not a party to any wager. ForeSkins does not host, bank, escrow, organize, sponsor, solicit, or take any fee, rake, commission, or cut tied to any game outcome. The Service does not facilitate, record, or track bets, wagers, or gambling of any kind. Any private financial arrangement among players in connection with a golf game is entirely outside the Service and is solely between those individuals.

2.3 We do not process payments or transmit money. The Service does not collect, hold, transmit, disburse, or reference funds of any kind. ForeSkins is not a money transmitter, payment processor, bank, or escrow agent. The Service does not integrate with, link to, or reference any payment service. Any financial arrangements among players are private matters between those individuals that occur entirely outside the Service and with which we have no involvement.

2.4 You are responsible for your own conduct. You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. ForeSkins makes no representation that the Service is appropriate or available in any particular jurisdiction. Your use of the Service is at your own risk and subject to applicable local law.

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• use the Service in connection with any gambling, wagering, or betting activity;
• harass, threaten, defraud, or harm other users;
• upload false, misleading, infringing, obscene, or otherwise objectionable content;
• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• reverse engineer, decompile, scrape, or interfere with the Service except as permitted by law;
• use the Service to send spam or unsolicited communications; or
• impersonate any person or misrepresent your affiliation.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe create legal risk for us or other users.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, including the accuracy of any score, handicap calculation, or points recorded in the Service.

We expressly disclaim any responsibility for disputes between users, including disputes over scores or game results.

To the fullest extent permitted by law, ForeSkins and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Please read this section carefully — it affects your legal rights.

13.1 Informal resolution. Before filing any claim, you agree to contact us at contact@foreskinsgolfco.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding arbitration. Except for claims that qualify for small-claims court and claims for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

13.3 Class-action waiver. You and ForeSkins agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims.

13.4 Opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@foreskinsgolfco.com with your name and a statement that you opt out of arbitration.
